Terms and conditions of service
These general conditions of sale govern all sales contracts concluded on the urcaspace.com website.
These general conditions of sale are available on the site to be easily read by the Customer before registration and before purchasing the products; they are considered accepted together with the registration and forwarding of the purchase order form, and can be stored on the Customer's computer and reproduced on paper by printing the file in which they are contained.
Urca Space reserves the right to modify these general conditions of sale at any time and without notice. Any changes will be effective from the moment they are published on the urcaspace.com website and will apply to sales made from that date.
The mere tolerance or failure to contest by Urca Space of any breaches by the Customer with respect to the contents of the general conditions of sale cannot be interpreted as tacit acceptance of such breaches, nor as a desire to derogate from what was agreed between the parties.
- Definitions
“Customer” means the person indicated on the order.
“Product” means the product offered by Urca Space.
“Order” means the order of the product placed by the Customer.
“Price” means the price in effect on the date and time the order was placed.
“General Conditions” means the standard terms and conditions of use of the site illustrated in this document.
- Restrictions on use
2.1. You may use this site only for purposes expressly permitted by law. As a condition of your use of this site, you warrant to Urca Space that you will not use the site for any unlawful or prohibited purpose.
2.2. The Customer undertakes to collaborate with Urca Space to prevent or remedy any unauthorized use of the site.
- Registration and purchasing procedure
3.1. The Customer who intends to proceed with the purchase of the products must express this desire by registering his/her data and a request made directly on the site where, following the purchase procedure indicated therein, he/she will forward, electronically, his/her purchase order and the relative payment.
3.2. The order form contains a reference to the general conditions of sale and a summary of each product ordered and its price, the chosen payment method, the delivery methods of the purchased products, shipping and delivery costs: it is the Customer's responsibility, before sending the order, to carefully read the entire content, identifying and correcting any errors in data entry.
3.3. Once the order has been received, Urca Space will send the Customer an order confirmation email, containing a summary of the content of the information relating to the sale, and will proceed with the order processing, without prejudice to the provisions of the following article 3.4.
3.4. In the event of non-execution of the order, due to unavailability of one of the products ordered, Urca Space will inform the Customer via email. In any case, the unavailability of one or more of the products ordered will not automatically give the Customer the right to cancel the entire order.
3.5. The Contract between the Customer and Urca Space is governed by the order, the order confirmation and the general conditions of sale (the latter published on the site), as well as by the Privacy Policy and the cookie policy, both published on the site.
- Prices and payment terms
4.1. All prices include VAT.
4.2. Shipping and delivery costs must be added to the prices shown on the site for each product.
4.3. The Customer assumes responsibility for paying any other taxes payable in the country to which the products are shipped.
4.4. Payment can be made by credit card, bank transfer or PayPal.
4.5. The products remain the property of Urca Space until the price has been paid.
4.6. The Customer guarantees that all data provided to Urca Space for the purpose of ordering and delivery are correct, that sufficient funds or credit resources are available to fully cover the cost of the products ordered. Urca Space reserves the right to verify the validity of the Customer's data before accepting the order.
- Product delivery methods
5.1. The products will be delivered to the address indicated on the order by courier, within 2-4 working days, 5 days for the Islands. Any delivery date of the products is however provided for indicative purposes.
5.2. The risk passes to the Customer at the latest upon delivery of the product to the carrier.
5.3. Upon shipment, the Customer will receive an email with the tracking number so that he can monitor the status of the shipment.
5.4. Upon delivery of the products to the Customer by the courier responsible for their transport, the Customer must check:
- a) that the quantity and type of products ordered correspond to those indicated in the transport document;
- b) that the packaging used for transport is intact, not damaged, wet or otherwise altered, even just in the sealing materials.
5.5. Any anomalies must be contested immediately to the courier upon receipt of the products, by indicating them on the delivery note.
- Rights and obligations of Urca Space
6.1. Urca Space undertakes to deliver the products to the address indicated by the Customer in the order and will not be responsible for delivery errors due to inaccuracies or incompleteness in completing the order or for the unavailability of the Customer.
6.2. In the event of total or partial return of the products pursuant to the right of withdrawal or the guarantee required by law, Urca Space will only refund the cost of the products.
- Limitations of liability
7.1. The images and colours of the products offered for sale on the site may not correspond perfectly to the real ones, since computer screens vary. Therefore, Urca Space cannot guarantee that the colour displayed on the Customer's monitor corresponds perfectly to the real colour of the products.
7.2. Urca Space assumes no responsibility for problems caused to the Customer by the use of the site and the technologies used as they do not depend on its own will, such as, by way of example: a) errors, delays or impossibility in accessing the site by the Customer during the execution of the sales procedure; b) errors, delays or impossibility in the receipt, by the Customer, of communications made by Urca Space in relation to the sale of the products.
7.3. Urca Space will not be responsible for incomplete deliveries by the carrier.
7.4. Urca Space shall not be held liable in any way for losses, damages, costs or expenses (including loss of profit) arising directly or indirectly from failure to perform or delays in fulfilling the obligations set out in these conditions of sale, due to events or circumstances beyond its reasonable control.
7.5. If such events make it significantly difficult for Urca Space to supply the product and the impediment is not only temporary, Urca Space has the right to withdraw from the contract. For impediments of temporary duration, the terms of supply will be extended or deferred for the duration of the impediment.
If, due to the delay, it is not conceivable for the Customer to accept the product, the Customer may withdraw from the contract by immediately sending a communication to the address urcaspace@gmail.com.
7.6. Urca Space cannot be held responsible in any way for losses or expenses incurred by the buyer due to delays in delivery of the products.
7.7. These limitations of liability shall take precedence over any inconsistent or contradictory clauses contained in the documents constituting the order.
- Right of withdrawal and production times
8.1. The Customer has the right to withdraw from the contract concluded with Urca Space, without any penalty within 14 (fourteen) working days from the date of delivery of the products, provided that the return procedure referred to in this article is respected and that the products to be returned are intact, complete with their packaging, tags and original labels. However, it is not possible to replace the product to be returned with another. The return is at the Customer's expense.
8.2. In the event of exercising the right of withdrawal, even partial, the only costs borne by the Customer will be those of returning the returned products which must be done in a single solution.
8.3. The shipment must be made from the country from which the order was placed and addressed to: Federica Perticarini via Solferino 101, Porto Sant'Elpidio 63821 (FM).
8.4. Furthermore, the right of withdrawal is considered to be correctly exercised if the Customer complies with the following requirements:
1) send, within 14 (fourteen) working days from delivery of the products, a notification email to urcaspace@gmail.com specifying in the text of the email the order number, the numeric code of the returned product or products, the quantities and the reason for the return;
2) send, at your own expense, the products being returned to the address indicated in point 8.3;
3) send a confirmation email to urcaspace@gmail.com , once the return has been shipped, indicating the shipping number.
8.5. If the right of withdrawal is exercised following the methods and terms indicated in this article, Urca Space will refund the Customer any sums already collected for the purchase of the returned products, once the goods have returned to the availability of Urca Space.
8.6. If the methods and terms for exercising the right of withdrawal, as specified in this article, are not respected, the Customer will not be entitled to a refund of the sums already paid to Urca Space.
- Returns for defects or non-conformities of products
9.1. Before shipping to the Customer, Urca Space subjects all products to a careful check on quality and any defects.
9.2. In the case of defective products or products that differ from those ordered, the Customer, without any exception, must:
1) send a notification email to Urca Space, at urcaspace@gmail.com specifying in the text of the email the order number, the products to be returned, the quantities and the reason for the return;
2) wait for instructions from Urca Space regarding the return procedures.
9.3. If the return for products affected by defects or non-conformities is exercised following the methods and terms indicated in this article, Urca Space will reimburse the Customer for the costs incurred by the Customer for the purchase of the same products and for the related shipping and delivery costs.

Competent court
In the case of Customers who can be classified as companies or professionals, any dispute arising from the interpretation, validity and/or execution of these general contract conditions will be subject to the jurisdiction of the Court of Fermo.
In the case of Customers who can be classified as consumers, any dispute arising from the interpretation, validity and/or execution of these general contract conditions will be subject to the jurisdiction of the judge of the place where the consumer has his/her residence or domicile or of the Court of Fermo, if the buyer has his/her domicile abroad.
